TERMS OF ONLINE SALES
Article 1: Preamble
TREBIUS VALENS SPRL the registered office is at 7131 BINCHE, rue du Transvaal 77, registered with the “Banque-Carrefour des Entreprises” under number BE0475 608 105 hereinafter referred to as "the seller", and any other natural or legal person wishing to make a purchase via the website http://www.trebiusvalens.com, hereinafter referred to as "the buyer".
Article 2: Purpose
The terms of sales are intended to define the contractual relationship between the seller and the buyer and the conditions applicable to any purchase, through the seller's website, whether the buyer is a professional or consumer.
The acquisition of goods through this website implies an unconditional acceptance of the buyer.
These terms of sale prevail over all other general or special conditions not expressly approved by the seller.
The seller reserves the right to modify his terms of sale at any time. In this case, the conditions applicable will be those on the date of the buyer’s order.
Article 3: Characteristics of goods and services offered
The products and services offered are those listed in the catalogue published on the seller's website.
Each product is accompanied by a description provided by the supplier.
The photographs in the catalogue are as accurate as possible, but cannot guarantee a perfect similarity with the offered product, especially regarding the colours.
These products and services are offered within the limits of available stocks. If, despite these efforts, all or part of the items are unavailable, the seller informs the buyer by email as soon as possible and gives him the opportunity to choose between waiting or cancelling without charge the order of unavailable items. Available items will be delivered normally.
Article 4: Rates
The prices of products and services displayed on the website are indicated in euros all taxes included (VAT and other applicable taxes).
The seller reserves the right to change prices at any time. However, the prices applicable to the order are those in effect at the time of confirmation. Special prices do not include order processing, shipping and delivery charges for the same as the charges in the geographic areas set out below.
Article 5: Geographical areas - Collection of the items ordered.
The online sale of products and services presented on the seller's website are only intended for buyers residing in the European Union.
Article 6: Orders
The buyer wishing to buy a product must:
- complete the identification form on which he will indicate all the details requested or give his customer number if he has one;
- fill out the online order form, giving all the references of the chosen products;
- validate his order after checking it;
- make the payment in the prescribed conditions;
- confirm his order and payment.
The confirmation of the order implies acceptance of these terms of sale, and the acknowledgment of having perfect knowledge of them. It also implies waiver of its own purchase conditions or others.

The seller will send confirmation of the recorded order by electronic mail.
Article 7: Right of cancellation
In accordance with the law, the consumer has the right to notify the seller that he waives his purchase, without penalty and without giving any reason, within 14 working days from the day after the delivery of the product or the conclusion of the service contract. This right of cancellation does not apply to professional buyers.
Within this period, the consumer must notify his intention to resign by electronic mail and return, at his expense and risk, the product delivered to the administrative headquarters of TREBIUS VALENS SPRL, rue du Transvaal 77 in 7131 Binche (Belgium).
The products must be returned in their original packaging, not damaged, accompanied by all their accessories, the user manual and the original invoice/delivery order.
The products returned must not have been unpacked, unsealed, used in any way.
Goods that are incomplete, damaged or soiled by the customer will not be taken back.
Within 30 days after acceptance of the return of the goods, the seller undertakes to repay any payment, except for the possible shipping costs.
Article 8: Terms of payment
Payment is made by credit card, bank transfer or other payment modules offered by banking institutions (including Visa or MasterCard) and set up on the website http://www.trebiusvalens.com.
The ordered items remain the exclusive property of the seller until the full payment of the order by the buyer.
Article 9: Deliveries
Ordered goods are delivered to the address indicated on the order form, which can only be in the agreed geographical area.
Goods are transported at the risk of the seller until the delivery of the goods to the delivery address specified by the buyer. From this moment, the buyer assumes all risks on his own. Delivery times are given as an indication; if they exceed thirty days from the order, the contract of sale may be cancelled, and the buyer refunded.
Article 10: Guarantee
With regard to consumers, the seller guarantees the products he sells, in accordance with the law of 1 September 2004 on the protection of consumers regarding sales of consumer goods (articles 1649 bis to 1649 octies of the Civil Code).
In case of nonconformity of goods sold within 2 months from delivery, the consumer must notify the seller as soon as possible in a precise manner by registered letter or electronic mail.
This warranty only covers defects of conformity at the time of delivery of the goods. Defects or damage due to misuse, such as water damage, oxidation, falling or shock, negligence and usury, are not covered by the warranty. Similarly, repairs performed by technicians not approved by the supplier will result in the cancellation of the warranty.
The original invoice or delivery note acts as a guarantee and must be kept by the consumer.
If the product is used for non-private purposes, the manufacturer’s/supplier’s limited warranty terms are in effect.
Article 11: Responsibility
The seller, in the process of online sales, is only bound by an obligation of means; his responsibility cannot be held liable for damage resulting from the use of the Internet, such as losses of data, intrusion, viruses, service interruption, or other unintended problems.
The data on the website are also given in good faith. The links offered to the websites of the manufacturers and/or partners are given for information purposes. The seller cannot be held responsible for information from these websites.
Article 12: Intellectual Property
All the elements of the seller’s website are and remain his intellectual and exclusive property.
No one is authorized to reproduce, exploit, rebroadcast, or use, in any way whatsoever, even partially, the elements of the website whether they are visual, sound or software.
Any simple or hypertext link is strictly forbidden without a prior written agreement of the seller.
Article 13: Personal Data
All personal data necessary for the processing of an order are kept by the seller or his collaborators and may be forwarded to the companies with which the seller – or its suppliers – collaborates, when such communication is necessary for the processing of the order.
The user also authorizes the seller to use this data to establish statistics in order to improve his website, goods and services he offers.
This information may also be used to allow the dissemination, by any means of communication, of information relating to the seller’s commercial activities to his clientele.
Finally, the seller keeps the personal data to facilitate subsequent orders. The seller undertakes not to disclose information available to another company or enterprise.
The data kept by the seller can at any time be requested and corrected on request.
Article 14: Proof
The parties agree, in the context of their relations, electronic means of proof (for example: email, computer backups, …).
Article 15: Litigation
The present terms of online sales are subject to the Belgian law.
In the event of litigation, the courts of the seller’s registered office would be competent, except in the case of restrictive provisions from public policies.
